WAVER AGREEMENT DRIVER, ENTRANT
The undersigned Driver and/or Entrant for him / herself, their, heirs, assigns and legal representatives, hereby expressly agrees to:
- Assumption of Risks
Assume any and all skills involved in or arising from Drivers, Entrants use of or presence upon the facilities including without limitation, death, bodily injury or property damage resulting from collision between a kart with another kart, or a person or a stationary object, overturning sudden stops, breaking or acceleration, fire or explosion, the unavailability of emergency medical care or the negligent act of another person.
- Release
Release Cyprus Automobile Association, Cyprus Karting Commission, Organizers, Organizing Committee of the Pancyprian Karting Championship, Daytona Raceway and all its successors, assigns, subsidiaries, franchises, affiliates, officials, directors, employees and agents from, and AGREES NOT TO SUE them on account or in connection with any claims, causes or actions, injuries, damages, cost of expenses arising our of Drivers or Entrants / Spectators use of or presence upon the Facilities, including without limitation, those based on death, mobility injury or other fault of the Cyprus Automobile Association, Cyprus Karting Commission, Organizers, Organizing Committee of the Pancyprian Karting Championship, Daytona Raceway including strict product liability.
- Waiver
Waiver the protection afforded by the statute or low in any jurisdiction whose purpose, substance and / or effect is to provide that a general release shall not extend to claims, material or otherwise, which the person giving the release does not know or suspect to exists at the time of executing the release.
- Indemnification
Indemnify and defend Cyprus Automobile Association, Cyprus Karting Commission, Organizers, Organizing Committee of the Pancyprian Karting Championship, Daytona Raceway against and hold it harmless from any and all claims, cause of action, damages, judgment, cost of expenses, including attorney’s fees, which any way arise from Drivers or Entrants use of or presence the Facilities without limitation the negligence if any of the Cyprus Automobile Association, Cyprus Karting Commission, Organizers, Organizing Committee of the Pancyprian Karting Championship, Daytona Raceway including all its successors, assigns, subsidiaries, franchises, affiliates, officers, directors, employees and agents.
- Payment
Pay for any and all damages to the faculties caused by the Driver or Entrant negligently, wilfully or otherwise.
I AM AWARE THAT ENGESING IN MOTOR SPORT IS A HAZARDOUS ACTIVITY, I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH THE KNOWLEDGE OF THE DANGER INVOLVED, AND HEREBY AGREE TO ACEPT ANY AND ALL RISK OF INJURY OR DEATH, AND VERIFY THIS STATEMENT BY ACCEPTING ALL CLAUSES.
